DIVORCE & FAMILY LAW
Contested
Divorce
Divorce varies on a case by case basis. The disruption of a
marriage can be painful.
Emotions range from anger, to depression, to hopelessness
manifest themselves frequently in clients seeking
vindication through litigation. While this objective may not
be practical, it is nonetheless real, and must be
acknowledged and accommodated.
Divorce is
litigation oriented. It is the courts that oversee all
aspects, including interim spousal maintenance, child
custody, fathers’ and grand parents’ rights, relocation,
support judgments, and visitation rights. We resolve these matters as early as
possible to order to protect the rights of our clients and
the children, and to save the client additional pain and
expense.
Divorce,
separations, and annulments are matters in which quality
representation is paramount. Actions must be taken to secure
assets, establish custody and visitation arrangements, as
well as secure necessary information for final settlement.
There are several key matters that must be addressed in a
divorce proceeding including:
Division
of Property
-
Complete information must be uncovered to
fairly establish the division of the community
estate
The Law Office of Charles E. Andersen brings to
bear the myriad skills needed in successful divorce
litigation. We have a keen understanding of business
and finance in order to either protect a client’s
assets or alternatively to insure a spouse receives
maximum share in equitable distribution. We are trained in uncovering assets, and
establishing a true value for such items as
professional licenses and practices, as well as
unique skills which translate into enhanced
earnings. Through this method, we can establish the
extent and value of the marital estate, including
the division of complex joint real estate, business
and corporate holdings.
Post-Divorce
Unfortunately, even after
divorce decrees become final, the enforcement of the
ruling sometimes requires legal intervention. We
have
experience in issues such as fathers’ rights, when
spouses deny fathers access to children, or
grandparents’ rights, when grandparents are denied
access to their grandchildren. In addition questions
frequently arise relating to child custody, family
relocation, visitation, alimony, and support
judgments. These issues must be properly addressed
to insure the rights of the client under the divorce
decree without undue confrontation that would
negatively impact the children involved.

Child Custody & Visitation
-

of the children, including a safe and stable
environment.
Questions concerning children are frequently the
most sensitive part of any divorce proceedings.
Issues of custody, child support, visitation and
grandparents’ rights must be resolved. The Law

the courts to obtain orders of protection to insure
a safe environment for spouses and children, or to
secure visitation when it is wrongfully denied.
Psychological insights into the needs of the
children, as well as the litigant parents, is an
important area of the attorney’s responsibility.
Drawing from life experiences and observations of a
myriad of other divorce clients, our attorneys help
guide clients through this most difficult time in
their lives.
Child Support
-
Based on the earnings and lifestyles of the
parties, adequate child support must be
determined.
Domestic Violence
-
When domestic violence is an issue, the
spouse and children must receive the proper
protection afforded by the law.
